  • Property Contract Dispute: Successfully Terminated Contract of Sale & Gained 10% Deposit Refund

    Our clients' purchased an off the plan property in 2016. The contract for sale provided that the plan must be registered by May 2019. The vendor failed to register the plan by May 2019. Our clients’ original solicitor who acted for the conveyance terminated the contract for sale. The vendor disputed the termination and alleged that the plan was registered before the termination was served on the vendor. Our clients did not want to purchase the property and requested a refund of the 10% deposit. Our clients’ original solicitor who acted for them in the conveyance was not able to terminate the contract with the vendor’s solicitor as the vendor insisted that our clients must purchase the property and believed that the termination was invalid.

    Our client obtained a full refund of their 10% deposit with all the interest earned on the deposit and to cancel the contract with the vendor.
