The Family Home After Separation: Selling or Transferring
Duty exemptions, mortgages and getting the paperwork in the right order
After a separation, the family home is usually either sold and the proceeds divided, or transferred to one partner who keeps it. Either way the property side has to line up with the family law agreement, or the transfer can cost far more than it should.
Optimum Lawyers is a property law firm in Parramatta Square, led by principal solicitor Wisam Assi. We act on purchases, sales, settlements and transfers in every Australian state and territory.

Ask us about transferring or selling the home
We offer a free initial contract assessment. It is a brief first look at whether the contract appears ready for a full paid legal review. It is not the full review, and it is not free conveyancing.
Get the agreement formalised first
A transfer between former partners can usually be made without transfer duty if it is made under family law court orders or a binding financial agreement. A transfer made on an informal agreement may attract full duty on the value of the share. The property transfer should follow the formal agreement, not come before it.
If one partner keeps the home
- The partner keeping the home usually needs to refinance the mortgage into their own name. The lender must agree to release the other partner.
- The transfer is lodged with the duty exemption claimed.
- Capital gains tax rollover relief may apply to transfers under court orders or financial agreements. Check with your accountant.
If the home is sold
Both owners usually need to sign the agency agreement and the contract. Agree in writing how the proceeds will be held and paid out, and who pays the mortgage until settlement. If one owner will not cooperate, a court can order a sale.
Our role
We handle the property side: the transfer, the duty exemption, dealing with the lenders, and the sale or settlement. We work with your family lawyer, or we can refer you to one.
What clients say
“Pricing was very reasonable and when the final invoice came it matched what was committed to at the start of the engagement.”

Questions about property after separation
Do I pay stamp duty when my ex transfers the house to me?
Usually not, if the transfer is made under family law court orders or a binding financial agreement. An informal agreement may not qualify.
Can I take my ex off the mortgage?
Only with the lender’s agreement, usually by refinancing into your own name.
Do we both have to sign to sell the house?
Yes, if you are both on the title. If one owner refuses, a court can order a sale.
Who handles the transfer?
A property lawyer handles the transfer and settlement, working with the family lawyer on the agreement.
