Land Tax in NSW: What Property Owners, Buyers and Sellers Need to Know
The 2026 thresholds, how land tax is worked out, and how it affects a sale
Land tax is an annual NSW tax on the unimproved value of land you own, other than your home and some other exempt land. Investors pay it every year, and it also matters when you buy or sell, because unpaid land tax is a charge on the land itself. Figures below are for the 2026 land tax year, as published by Revenue NSW.
Optimum Lawyers is a property law firm in Parramatta Square, led by principal solicitor Wisam Assi. We act on purchases, sales, settlements and transfers in every Australian state and territory.

2026 thresholds and rates
| Total taxable land value | Land tax for 2026 |
|---|---|
| Up to $1,075,000 | Nil |
| $1,075,001 to $6,571,000 | $100 plus 1.6% of the value above $1,075,000 |
| Over $6,571,000 | A higher rate of 2% applies above the premium threshold |
The threshold applies to the combined value of all your taxable NSW land, not to each property separately.
How land tax is worked out
- Taxing date: land tax is based on the taxable land you own at midnight on 31 December, and covers the following year.
- Land value: Revenue NSW uses the Valuer General's land values, averaged over three years where available.
- Not pro rata: if you sell in February, you still pay land tax for that year.
- Trusts: the threshold does not apply to land held in special or discretionary trusts.
- Foreign owners: surcharge land tax applies to foreign persons who own residential land, unless an exemption applies.
Your home
Your principal place of residence is generally exempt. From the 2026 land tax year, the people living in the home must together own at least 25% of it for the exemption to apply. Check the rules if you share ownership with family who do not live there.
Buying and selling
Because unpaid land tax is a charge on the land, a buyer's lawyer obtains a land tax certificate before settlement and makes sure any tax owing is cleared. Whether land tax is adjusted between buyer and seller depends on the contract, so check the special conditions before you exchange. See the NSW contract for sale.
Structuring and transfers
Moving property into a trust or company, or changing the names on a title, can change your land tax position. Get advice before you sign. See buying property in a trust.
