Stamp Duty in Western Australia: What Buyers Need to Know
The first home owner rate from 7 May 2026, foreign buyer duty and interstate purchases
Transfer duty in Western Australia is administered by RevenueWA. The thresholds for first home buyers changed on 7 May 2026, and the rate that applies is set by the date you enter the agreement, not the settlement date.
Optimum Lawyers is a property law firm in Parramatta Square, led by principal solicitor Wisam Assi. We act on purchases, sales, settlements and transfers in every Australian state and territory.

Send us the offer and we will check the duty
We offer a free initial contract assessment. It is a brief first look at whether the contract appears ready for a full paid legal review. It is not the full review, and it is not free conveyancing.
First home owner rate from 7 May 2026
| Property | No duty | Reduced duty |
|---|---|---|
| Home and land | Up to $600,000 | $600,001 to $800,000 |
| Vacant land | Up to $450,000 | $450,001 to $550,000 |
You generally need to qualify for the First Home Owner Grant or meet one of the listed exceptions, such as buying an established home. If approval is not in place before settlement, duty is assessed at the general rate and you apply for a refund later. See the RevenueWA fact sheet. See also the First Home Owner Grant in WA.
Foreign buyers
Foreign persons pay foreign transfer duty of 7% on residential property in WA, on top of transfer duty. It still applies to a foreign person's share of a property even where an Australian co-buyer gets the first home owner rate.
WA has no cooling-off period
Once the Offer and Acceptance is signed by both parties you are bound, subject to any conditions in it. Duty, finance and inspection issues need to be dealt with before you sign, not after. See cooling-off periods by state.
Buying in WA from interstate
WA duty applies to WA property wherever you live, and the first home owner rate is designed for buyers who will live in the home. We advise interstate buyers on the Offer and Acceptance and the duty before they sign. See Perth conveyancing and settlements.
