Bairnsdale Conveyancing and Property Lawyers
Bushfire, river flats and lakes properties in East Gippsland
Bairnsdale is the main town of East Gippsland, near the Gippsland Lakes and a long way from Melbourne. The region was hit hard by the 2019 to 2020 bushfires, and bushfire and flood overlays affect many properties.
Optimum Lawyers is a property law firm in Parramatta Square, led by principal solicitor Wisam Assi. We act for buyers and sellers in every Australian state and territory, including interstate owners who cannot attend in person.

Send us the contract and Section 32 before you sign
We offer a free initial contract assessment. It is a brief first look at whether the contract appears ready for a full paid legal review. It is not the full review, and it is not free conveyancing.
Checks that are specific to Bairnsdale
- Bushfire overlays. Many lots are in a Bushfire Management Overlay, which affects building and insurance
- Flood-prone land. Lots near the Mitchell River and the lakes can be flood affected. Check the planning overlays
- Rural and lifestyle blocks. Check access, water, wastewater, fencing and zoning
- Lakes properties. Check approvals for jetties and any Crown land licences for frontage
Victorian contract basics
The Section 32 vendor statement is given to you before you sign, and if it is missing, incomplete or inaccurate the contract may not be binding on the buyer. The cooling-off period is 3 clear business days from the day you sign, and you forfeit the greater of $100 or 0.2% of the price if you withdraw. There is none at auction. Since 1 October 2026 the agent must disclose the seller's reserve price at least 7 days before an auction or fixed-date sale.
Selling in Bairnsdale
The Section 32 must be complete and accurate. In most residential sales the seller's land tax can no longer be passed on to the buyer. Every seller needs an ATO clearance certificate, or the buyer must withhold 15% of the price at settlement.
Transfers without a sale
We also act on transfers between partners, after a separation, from a deceased estate, and into or out of a trust or self-managed super fund. Victorian duty can apply even where no money changes hands, so get advice before anything is signed. See stamp duty in Victoria.
Lawyer or conveyancer?
A conveyancer can handle a simple purchase well. A property lawyer can also advise on the contract before you sign, negotiate its terms, and act for you if the sale is disputed.
