Doncaster has seen many older houses replaced by townhouses and apartments, especially around Doncaster Hill. That means more owners corporations, more subdivisions and more overlays to check in the Section 32.

Checks that are specific to Doncaster
- Planning overlays. Check the zoning and overlays listed in the Section 32. They control what can be built and how much vegetation can be removed
- Townhouse subdivisions. Check the plan of subdivision, common property and any owners corporation rules
- Apartments. Check the owners corporation certificate, levies, maintenance plan and any special levies
- Older homes. Check building permits for extensions and pools, and pool barrier compliance
Victorian contract basics
The Section 32 vendor statement is given to you before you sign, and if it is missing, incomplete or inaccurate the contract may not be binding on the buyer. The cooling-off period is 3 clear business days from the day you sign, and you forfeit the greater of $100 or 0.2% of the price if you withdraw. There is none at auction. Since 1 October 2026 the agent must disclose the seller's reserve price at least 7 days before an auction or fixed-date sale.
Selling in Doncaster
The Section 32 must be complete and accurate. In most residential sales the seller's land tax can no longer be passed on to the buyer. Every seller needs an ATO clearance certificate, or the buyer must withhold 15% of the price at settlement.
Transfers without a sale
We also act on transfers between partners, after a separation, from a deceased estate, and into or out of a trust or self-managed super fund. Victorian duty can apply even where no money changes hands, so get advice before anything is signed. See stamp duty in Victoria.
Lawyer or conveyancer?
A conveyancer can handle a simple purchase well. A property lawyer can also advise on the contract before you sign, negotiate its terms, and act for you if the sale is disputed.

The plan of subdivision, owners corporation certificate, zoning and overlays, and any building permits.
Is there cooling-off when buying in Doncaster?
Yes, 3 clear business days on most private sales in Victoria, but not at auction.
How long is the cooling-off period in Victoria?
Three clear business days from the day you sign. You forfeit the greater of $100 or 0.2% of the price if you withdraw, and there is none at auction.
Can a NSW law firm act on a Victorian property?
Yes. NSW and Victoria are both part of the Legal Profession Uniform Law.

I recently sold my investment property with Wisam of Optimum Lawyers as solicitor. I had used Wisam some 14 years earlier in the purchase of the property and subsequently with other property purchases. Much of the work involved with the sale of the property this year took place while I was away on my family's first and long-delayed overseas trip to see relatives. Wisam kept me well updated and informed throughout the process, especially as he dealt with a challenging purchaser solicitor who seemed frequently otherwise distracted and asking for multiple settlement delays. While we agreed to accommodate as much as was acceptable, Wisam strongly asserted my rights in having the sale proceed promptly as per the contract. I plan to ask Wisam to deal with future sales and purchases as and when they occur.
