Tasmania is a buyer beware state. There is no statutory cooling-off period, the seller does not have to give you a disclosure statement, and the standard contract has few ways out once you sign. For a buyer in Sydney or Melbourne, that means the checking has to happen before the contract, not after it.
Optimum Lawyers is a Parramatta property law firm that acts on Tasmanian purchases, sales and transfers for clients who live in other states.

Send us the contract before you sign it
We offer a free initial contract assessment. It is a brief first look at whether the contract appears ready for a full paid legal review. It is not the full review, and it is not free conveyancing.
How a Hobart purchase runs
- No statutory cooling-off. Tasmanian law does not require one. A cooling-off clause is an optional term in the standard contract, and the seller does not have to agree to it.
- The standard contract. Most sales use the contract published by the Law Society of Tasmania and the Real Estate Institute of Tasmania. Its exit clauses are usually limited to finance and a building inspection.
- Buyer beware. There is no general seller disclosure statement. Problems with the property are yours to find.
What to check before you sign
- The council certificate. A section 337 certificate from the council shows whether completion certificates and occupancy permits were issued, any outstanding enforcement, and the zoning.
- A building inspection. Keep the condition in the contract and use a qualified inspector.
- Landslip. Tasmania has declared landslip areas, including one at Rosetta in Glenorchy, and affected titles should carry a notation. Some have been missed, so check rather than assume.
- Bushfire. Hobart’s suburbs run up into bush on the slopes of kunanyi / Mount Wellington, and bushfire prone land carries building requirements.
- Heritage. Older areas such as Battery Point and parts of Sandy Bay include heritage listed places that limit change.
Greater Hobart is several councils
Hobart, Glenorchy, Clarence and Kingborough are separate councils, each issuing its own certificates and keeping its own building records. The search depends on which side of the Derwent the property is on.
Selling a Hobart property from interstate
Every seller needs an ATO clearance certificate, or the buyer must withhold 15% of the price at settlement. If the property is tenanted, the lease and bond are dealt with in the contract. You sign from home.
Transfers without a sale
We also act on transfers between partners, after a separation, from a deceased estate, and into or out of a trust or self-managed super fund. Tasmanian duty can apply even where no money changes hands, so get advice before anything is signed.
Lawyer or conveyancer?
A licensed conveyancer can handle a simple Tasmanian purchase well. In a buyer beware state with no cooling-off, a property lawyer adds advice on the contract before you sign, conditions written for the risks of the property, and representation if something goes wrong.

Questions about conveyancing in Hobart
Is there a cooling-off period in Tasmania?
No. Tasmanian law does not require one. A cooling-off clause can be included in the contract only if the seller agrees.
What is a 337 certificate?
A land information certificate from the local council. It shows completion certificates and occupancy permits, outstanding enforcement and the zoning of the property.
Does a Tasmanian seller have to disclose defects?
There is no general seller disclosure statement in Tasmania. The buyer carries most of the responsibility for checking the property.
Can a NSW law firm act on a Hobart purchase?
Yes. A solicitor holding a current Australian practising certificate can act on property in any state or territory.
Do I need to travel to Hobart?
No. Documents are signed where you live and we deal with the agent and the other side for you.
