If you are selling in Sydney to buy on the Sunshine Coast, you are running two transactions under two sets of rules, and the dates have to line up. Most of the risk sits in the gap between them.
Optimum Lawyers is a Parramatta property law firm that acts on NSW sales and Queensland purchases, so one firm can run both ends.

Talk to us before you sign either contract
We offer a free initial contract assessment. It is a brief first look at whether the contract appears ready for a full paid legal review. It is not the full review, and it is not free conveyancing.
Selling in NSW and buying in Queensland
- The contracts start differently. In NSW the seller’s solicitor or conveyancer prepares the contract before the property is advertised. In Queensland the agent usually prepares it when you make the offer.
- The cooling-off periods start differently. Both are 5 business days. In NSW it runs from exchange. In Queensland it runs from the day you receive the contract signed by both parties.
- A subject to sale condition. If the purchase depends on your Sydney sale, the Queensland contract needs a condition that says so, with dates you can meet. Without it you can be bound to buy before you have sold.
What to check depends on where you buy
- Beachside units. Around Mooloolaba, Maroochydore and Caloundra, the body corporate certificate and by-laws decide your costs and what you can do with the unit.
- Canal homes. Check the revetment wall and whether the pontoon or jetty was approved.
- New estates. Land in the large estates south of Caloundra and around Palmview is often sold before the lot is registered. Look at the sunset date, what the developer can change, and the building covenants.
- Hinterland acreage. Around Maleny, Montville and Mapleton, expect rainwater tanks, on-site sewage systems, access easements and vegetation rules. None of them appear on a suburban checklist.
- Two councils. Noosa Shire and Sunshine Coast Council are separate, with their own planning schemes and their own rules on short-term letting.
Disclosure, and what it leaves out
Since 1 August 2025 a Queensland seller must give you a seller disclosure statement (Form 2) and prescribed certificates before you sign. The statement does not cover flooding history, the structural soundness of the building, or past building approvals. Check the council flood mapping for the address and keep a building and pest condition in the contract.
Selling a Sunshine Coast property from interstate
The disclosure documents must reach the buyer before they sign, or the buyer may be able to terminate up to settlement. A dwelling being sold needs interconnected photoelectric smoke alarms, and a pool needs a pool safety certificate. We prepare the disclosure and you sign from home.
Transfers without a sale
We also act on transfers between partners, after a separation, from a deceased estate, and into or out of a trust or self-managed super fund. Queensland transfer duty can apply, so get advice first.
Lawyer or conveyancer?
A conveyancer can handle a simple purchase well. When a move depends on two contracts in two states, a property lawyer can advise on both, write the conditions that tie them together, and act for you if one side falls over.
What clients say about our Queensland work
“he made the entire process so easy buying my first block of land interstate.”

Questions about conveyancing on the Sunshine Coast
Can one firm act on my NSW sale and my Queensland purchase?
Yes. We act on both, which lets us set the settlement dates so the sale funds are there when the purchase settles.
What is a subject to sale condition?
A term that makes your purchase depend on the sale of your current home by a set date. If the sale does not happen in time, the condition lets you end the purchase contract.
What should I check when buying land that is not yet registered?
The sunset date, how the deposit is held, how much the developer can change the lot, and the building covenants that will bind you once you own it.
Does seller disclosure cover flooding?
No. Flooding history is not part of the Queensland seller disclosure statement.
How long is the cooling-off period?
Five business days from the day you receive the fully signed contract. The seller can keep up to 0.25% of the price if you withdraw.
