A Townsville purchase from interstate usually means buying a property you have not stood in, in a climate your home state does not have. The contract has to carry more of the risk.
Optimum Lawyers is a Parramatta property law firm that acts on Queensland purchases and sales for clients who live in other states.

Send us the contract before you sign it
We offer a free initial contract assessment. It is a brief first look at whether the contract appears ready for a full paid legal review. It is not the full review, and it is not free conveyancing.
Three checks before the contract goes unconditional
- Insurance. Get a written quote for the actual address before your finance and inspection dates pass. Cyclone and flood exposure drive premiums in North Queensland. The federal cyclone reinsurance pool covers home, landlord and residential strata policies and was set up to bring those premiums down, but a quote for one address tells you nothing about another.
- Flood. Townsville City Council runs a flood mapping service, and parts of the city flooded in the February 2019 monsoon event. Queensland’s seller disclosure does not cover flooding history, so this search is yours to do.
- Construction. Homes built before the early 1980s predate current cyclone construction standards. Ask the building inspector how the roof is tied down, not only whether the frame is sound.
Properties leased to Defence Housing Australia
Townsville is a garrison city, and some investment properties are leased to Defence Housing Australia. The lease stays with the property when it sells. Read its remaining term, the rent review terms and the make-good obligations before you settle on a price.
Units and townhouses
A unit is sold with a body corporate certificate. In North Queensland the building’s insurance is a major part of the budget, so look at the levies and the last budget together.
Queensland contract basics
The agent usually prepares the contract. The cooling-off period is 5 business days from the day you receive it signed by both parties, and the seller can keep up to 0.25% of the price if you withdraw. Since 1 August 2025 the seller must give you a seller disclosure statement (Form 2) and prescribed certificates before you sign.
Selling a Townsville property from interstate
The disclosure documents go to the buyer before they sign. A dwelling being sold needs interconnected photoelectric smoke alarms. If the property is tenanted, the lease and bond are dealt with in the contract. You sign from home.
Transfers without a sale
We also act on transfers between partners, after a separation, from a deceased estate, and into or out of a trust or self-managed super fund. Queensland transfer duty can apply, so get advice first.
Lawyer or conveyancer?
A conveyancer can handle a simple purchase well. An investor buying sight unseen needs more than the paperwork processed: advice on the contract and any existing lease before signing, conditions written for the risks of the address, and someone to act if the property is not as described.
What clients say about our Queensland work

Questions about conveyancing in Townsville
Should I get an insurance quote before I sign?
Get it before the contract becomes unconditional at the latest. If the premium changes the numbers, you want to find out while you can still withdraw.
Does a Townsville seller have to disclose flooding?
No. Flooding history is outside the Queensland seller disclosure scheme. Use the council’s flood mapping.
What happens to a Defence Housing lease when the property sells?
It continues. The buyer takes the property subject to the lease, so its terms are part of what you are buying.
Can I buy without inspecting in person?
Yes. The building and pest condition, the searches and a pre-settlement inspection by someone you trust do the work a visit would.
How long is the cooling-off period?
Five business days from the day you receive the fully signed contract. There is none at auction.
