Since 1 August 2025, a Queensland seller must give the buyer a seller disclosure statement, the Form 2, and a set of prescribed certificates before the buyer signs the contract. If they are missing, or wrong on a material point, the buyer may be able to walk away right up to settlement and get every dollar back.
Optimum Lawyers is a property law firm in Parramatta Square, led by principal solicitor Wisam Assi. We act on property in every Australian state and territory.

Have your disclosure statement prepared or checked
We offer a free initial contract assessment. It is a brief first look at whether the contract appears ready for a full paid legal review. It is not the full review, and it is not free conveyancing.
What the seller must give
- The Form 2 statement, covering matters such as the title, zoning, heritage listing, council and water rates, and whether there is a pool.
- Prescribed certificates, including a title search and a copy of the registered plan.
- For a unit or townhouse in a community titles scheme, a body corporate certificate and the community management statement.
- Notices under building, planning and environmental legislation, where they affect the land.
All of it must be given before the buyer signs. It is good practice to attach the certificates to the statement.
What happens if it is wrong
A buyer may terminate at any time before settlement if a compliant statement or certificate was not given before they signed. They may also terminate if it was inaccurate or incomplete on a material matter, they did not know the true position, and they would not have signed had they known. On termination the buyer gets a full refund of everything paid. Council and water rates are excluded from the materiality test.
What it does not cover
The scheme does not require disclosure of flooding history, the structural soundness of the building, or past building approvals. Buyers still need searches, flood information and a building inspection.
Exemptions
Some sales are exempt or allow a waiver, for example certain related-party sales, sales to government bodies, sales between co-owners, sales under a court order or financial agreement, and some sales over $10 million. Get advice before relying on one.
Selling in Queensland from another state
Many Queensland sellers live interstate. We prepare and check disclosure statements and certificates for clients wherever they live. See QLD interstate conveyancing.

Questions about Queensland seller disclosure
When must the seller disclosure statement be given?

Can a buyer terminate if the disclosure is wrong?
Yes, at any time before settlement, if it was not given or was inaccurate or incomplete on a material matter and the buyer would not have signed had they known.
Does the Form 2 cover flooding?
No. Flooding history is outside the scheme.
Does it apply to off-the-plan lots?
The requirements do not apply to proposed lots, although other disclosure rules for community titles schemes still apply.
