Queensland changed the way properties are sold on 1 August 2025. Sellers now have to give buyers a disclosure statement and certificates before the contract is signed, and a disclosure that is missing or wrong can let a buyer walk away. That has made the legal side of a Brisbane purchase more important, not less.
Optimum Lawyers is a property law firm led by principal solicitor Wisam Assi. We act on Brisbane purchases, sales and transfers for clients in Queensland and interstate.

Send us the contract and disclosure statement before you sign
We offer a free initial contract assessment. It is a brief first look at whether the contract appears ready for a full paid legal review. It is not the full review, and it is not free conveyancing.
What a property lawyer adds
A conveyancer can process a simple Brisbane purchase well. A lawyer can also tell you what a defect in the disclosure means for your rights, negotiate the special conditions, and act for you if the buyer, seller or body corporate becomes a dispute.
Matters we handle in Brisbane
- Seller disclosure. We check the Form 2 statement and the certificates against the title and searches. If they were not given or are materially wrong, a buyer may be able to terminate before settlement.
- What disclosure leaves out. Flooding history, the structural soundness of the building and past building approvals are outside the scheme. Brisbane City Council's FloodWise Property Report and a building inspection fill some of that gap.
- Body corporate. Levies, sinking fund, by-laws, defect claims and disputes. Body corporate disputes go to the Commissioner for Body Corporate and Community Management before any tribunal.
- Time is of the essence. Under the standard Queensland contract, settlement on the due date is essential. A party who is not ready on the day can be in default, so dates for finance, inspections and settlement need managing closely.
- Foreign buyers. Queensland charges additional foreign acquirer duty of 8% on residential land.
Selling in Brisbane
The seller disclosure statement and certificates must reach the buyer before they sign. A dwelling needs interconnected photoelectric smoke alarms, and a pool needs a pool safety certificate. Every seller needs an ATO clearance certificate, or the buyer must withhold 15% of the price at settlement.
Transfers and ownership
We act on transfers between partners, after a separation, from a deceased estate, and into or out of a trust or self-managed super fund. Queensland transfer duty can apply even where no money changes hands, so the structure needs settling before the transfer is signed.
Buying in Brisbane from another state
The cooling-off period is 5 business days and runs from the day you receive the contract signed by both parties. There is none at auction. See conveyancing in Brisbane for how the process runs and what to check by suburb.

Questions about property lawyers in Brisbane
What happens if the seller disclosure statement is wrong?
If it was not given, or is inaccurate or incomplete in a material respect, you may be able to terminate before settlement. Get advice before you act.
Does Queensland seller disclosure cover flooding?
No. Flooding history is outside the scheme. Check the council flood information for the address.
What does time is of the essence mean?
Under the standard Queensland contract, settlement on the due date is essential. Missing it can put a party in default.
Can a NSW law firm act on a Brisbane property?
Yes. A solicitor holding a current Australian practising certificate can act on property in any state or territory.
