If you are looking for a settlement agent in Perth, you have a second option. In Western Australia a settlement can be carried out by a licensed settlement agent or by a lawyer. Optimum Lawyers is a law firm, not a licensed settlement agent, and we handle WA settlements as lawyers.
The difference is what comes with it. A lawyer can tell you whether to sign the offer, how the conditions should be worded, and what to do if the other side does not perform.

Send us the offer before you sign it
We offer a free initial contract assessment. It is a brief first look at whether the contract appears ready for a full paid legal review. It is not the full review, and it is not free conveyancing.
What a settlement agent does
Licensed settlement agents are regulated under the Settlement Agents Act 1981 and are the usual choice in WA. They prepare the settlement documents, check that the conditions of the contract have been met, calculate the adjustments for rates, water and strata levies, handle the funds, and lodge the transfer with Landgate. For a straightforward purchase that is the job, and a good settlement agent does it well, often for a lower fee than a lawyer.
Where a lawyer is different
- Before you sign. A settlement agent is usually appointed after the offer has been accepted, when the contract can no longer be changed. We can read the offer first and fix the conditions while you still can.
- Legal advice. A settlement agency is not a law practice. Questions about how a condition should be worded, whether you can end the contract, or what a strata order means are legal questions.
- When it goes wrong. If finance falls through, a party will not settle or a defect turns up, a lawyer can advise and act for you.
- Beyond the sale. Transfers between family members, SMSF purchases, deceased estates and caveats.
What we handle on a Perth settlement
- Review the offer and conditions, ideally before you sign.
- Search the title at Landgate, including easements, caveats and covenants, and the strata documents for a strata lot.
- Track the finance and inspection dates.
- Arrange transfer duty through RevenueWA and prepare the settlement statement.
- Settle electronically and register the transfer.
For buyers and sellers outside WA
Many of our WA clients live in NSW, Victoria or Queensland. You sign where you live, your identity is verified where you live, and settlement is electronic, so there is no need to fly to Perth.
Selling a Perth property
Before the title transfers, at least two RCDs must protect the power and lighting circuits, and compliant mains-powered smoke alarms must be in place before the sale. A strata seller must give the buyer the prescribed disclosure before they sign. Every seller needs an ATO clearance certificate, or the buyer must withhold 15% of the price.
What clients say about our WA work
“Wisam and team are fantastic, supported a tenanted dual-occupancy WA settlement and delivered well!”

Questions about settlement agents in Perth
Do I have to use a settlement agent in WA?
No. A WA settlement can be handled by a licensed settlement agent or by a lawyer.
Are you a licensed settlement agent?
No. Optimum Lawyers is a law firm. Lawyers can carry out WA settlements as part of their legal practice.
When should I contact you?
Before you sign the offer. Once the seller accepts it, the terms are fixed and WA has no statutory cooling-off period.
Is a lawyer more expensive than a settlement agent?
Often, yes. The fee covers legal advice on the contract as well as the settlement. We tell you the cost before you engage us.
Can a NSW law firm handle a Perth settlement?
Yes. NSW and WA are both part of the Legal Profession Uniform Law.
