Narre Warren and Berwick are the established heart of the City of Casey, one of Victoria's most populous council areas. Buyers here are mostly families trading up, with newer estates to the south and east and older character homes in Berwick village.

We offer a free initial contract assessment. It is a brief first look at whether the contract appears ready for a full paid legal review. It is not the full review, and it is not free conveyancing.
Checks that are specific to Narre Warren
- Growth Areas Infrastructure Contribution. Casey is one of the seven councils where GAIC can apply to growth area land. For established homes it is usually not an issue, but the Section 32 should say.
- Heritage. Parts of Berwick carry heritage overlays that control demolition and change.
- Estate covenants. Newer estates often carry covenants on fencing, building materials and further subdivision.
- Auctions. No cooling-off once the hammer falls, and the reserve must be disclosed at least 7 days before.
Victorian contract basics
The Section 32 vendor statement is given to you before you sign, and if it is missing, incomplete or inaccurate the contract may not be binding on the buyer. The cooling-off period is 3 clear business days from the day you sign, and you forfeit the greater of $100 or 0.2% of the price if you withdraw. There is none at auction. Since 1 October 2026 the agent must disclose the seller's reserve price at least 7 days before an auction or fixed-date sale.
Selling in Narre Warren
The Section 32 must be complete and accurate. In most residential sales the seller's land tax can no longer be passed on to the buyer. Every seller needs an ATO clearance certificate, or the buyer must withhold 15% of the price at settlement.
Transfers without a sale
We also act on transfers between partners, after a separation, from a deceased estate, and into or out of a trust or self-managed super fund. Victorian duty can apply even where no money changes hands, so get advice before anything is signed.
Lawyer or conveyancer?
A conveyancer can handle a simple purchase well. A property lawyer can also advise on the contract before you sign, negotiate its terms, and act for you if the sale is disputed.

Questions about conveyancing in Narre Warren
Does GAIC apply to an established home in Narre Warren?
Usually not, but it can apply to growth area land in Casey. The Section 32 should state whether it affects the lot.
What does an estate covenant do?
It restricts what can be built or done on the land, such as fencing, materials or subdivision. It is shown on the title.
How long is the cooling-off period in Victoria?
Three clear business days from the day you sign. You forfeit the greater of $100 or 0.2% of the price if you withdraw, and there is none at auction.
Can a NSW law firm act on a Victorian property?
Yes. NSW and Victoria are both part of the Legal Profession Uniform Law.

I recently sold my investment property with Wisam of Optimum Lawyers as solicitor. I had used Wisam some 14 years earlier in the purchase of the property and subsequently with other property purchases. Much of the work involved with the sale of the property this year took place while I was away on my family's first and long-delayed overseas trip to see relatives. Wisam kept me well updated and informed throughout the process, especially as he dealt with a challenging purchaser solicitor who seemed frequently otherwise distracted and asking for multiple settlement delays. While we agreed to accommodate as much as was acceptable, Wisam strongly asserted my rights in having the sale proceed promptly as per the contract. I plan to ask Wisam to deal with future sales and purchases as and when they occur.
