Plenty of Mornington Peninsula property is bought as a second home. Buyers from Melbourne and interstate pick up beach houses in Sorrento and Rye, units in Mornington, and acreage around Red Hill and Main Ridge. The Section 32 and the planning controls on the land matter more here than in most places.
Optimum Lawyers is a property law firm led by principal solicitor Wisam Assi. We act on Victorian purchases, sales and transfers for clients in Victoria and interstate.

Send us the contract and Section 32 before you sign
We offer a free initial contract assessment. It is a brief first look at whether the contract appears ready for a full paid legal review. It is not the full review, and it is not free conveyancing.
Checks that are specific to Mornington Peninsula
- Green Wedge land. Much of the hinterland is in the Green Wedge, where subdivision and some uses are tightly limited. Check what the zone allows before you plan anything.
- Coastal land. Beachfront and clifftop blocks can be affected by erosion and coastal hazard controls.
- Bushfire. Bushfire Management Overlays apply on parts of the peninsula, including around Arthurs Seat, and affect building and rebuilding.
- Unsewered lots. Some areas rely on septic systems, which need council approval and maintenance.
- Holiday homes and land tax. A holiday home is not your principal place of residence, so Victorian land tax can apply. Work out the holding costs before you buy.
Victorian contract basics
The Section 32 vendor statement is given to you before you sign, and if it is missing, incomplete or inaccurate the contract may not be binding on the buyer. The cooling-off period is 3 clear business days from the day you sign, and you forfeit the greater of $100 or 0.2% of the price if you withdraw. There is none at auction. Since 1 October 2026 the agent must disclose the seller's reserve price at least 7 days before an auction or fixed-date sale.
Selling in Mornington Peninsula
The Section 32 must be complete and accurate. In most residential sales the seller's land tax can no longer be passed on to the buyer. Every seller needs an ATO clearance certificate, or the buyer must withhold 15% of the price at settlement.
Transfers without a sale
We also act on transfers between partners, after a separation, from a deceased estate, and into or out of a trust or self-managed super fund. Victorian duty can apply even where no money changes hands, so get advice before anything is signed.
Lawyer or conveyancer?
A conveyancer can handle a simple purchase well. A property lawyer can also advise on the contract before you sign, negotiate its terms, and act for you if the sale is disputed.
