Victoria leaves less room for second thoughts than most states. The cooling-off period is three business days, there is none at auction, and much of what protects a buyer depends on whether the Section 32 statement is complete and accurate. Those are legal questions, and they are easier to deal with before you sign than after.
Optimum Lawyers is a property law firm led by principal solicitor Wisam Assi. We act on Melbourne purchases, sales and transfers for clients in Victoria and in other states.

Send us the contract and Section 32 before you sign
We offer a free initial contract assessment. It is a brief first look at whether the contract appears ready for a full paid legal review. It is not the full review, and it is not free conveyancing.
What a property lawyer adds
Victoria has many good licensed conveyancers, and a straightforward purchase is well within what they do. A lawyer can also advise on the legal position around the property and the people buying it, negotiate the special conditions, and act for you if the sale turns into a dispute.
Matters we handle in Melbourne
- Section 32 statements. If the vendor statement was not given, or is materially incomplete or inaccurate, a buyer may be able to end the contract before settlement. We check it against the title, the certificates and what the agent told you.
- Auctions. There is no cooling-off after the hammer falls. Since 1 October 2026 the agent must disclose the reserve at least 7 days before an auction or fixed-date sale, which gives a window to have the contract read first.
- Off-the-plan. A developer cannot end a residential off-the-plan contract under a sunset clause without the buyer's written consent or an order of the Supreme Court. We check the plan, the changes the developer is allowed to make, and the deposit terms.
- Owners corporations. Fees, special levies, rules, and any proceedings recorded on the owners corporation certificate.
- Deposit release. A vendor can ask to have the deposit released before settlement under section 27 of the Sale of Land Act, and the buyer has a short time to object. That request is worth a legal read.
Selling in Melbourne
The Section 32 is the seller's document, and errors in it can cost the sale. In most residential sales the seller's land tax can no longer be passed on to the buyer through the settlement adjustments. In seven growth area councils, the Growth Areas Infrastructure Contribution may also be payable. Every seller needs an ATO clearance certificate, or the buyer must withhold 15% of the price at settlement.
When a sale does not go to plan
Default notices, late settlements, unpaid adjustments, and disputes about the condition of the property at handover all turn on the contract terms and the notices served under them. We advise on your position and deal with the other side.
Transfers and ownership
We act on transfers between spouses and partners, after a separation, from a deceased estate, and into or out of a trust or self-managed super fund. Victorian duty can apply even where no money changes hands, and some transfers between spouses are exempt with conditions. Foreign purchasers pay an additional duty of 8% on residential property.
Buying in Melbourne from another state
You do not need to be in Victoria. Documents are signed where you live and settlement is electronic. See conveyancing in Melbourne for how the Victorian process runs step by step.

Questions about property lawyers in Melbourne
Can I end a contract if the Section 32 is wrong?
Possibly. If the statement was not given or is materially defective, the buyer may be able to end the contract before settlement. It depends on the defect and whether you were misled.
Is there a cooling-off period at a Melbourne auction?
No. An auction purchase is binding when the hammer falls, and so is a private sale made within 3 clear business days before or after a publicly advertised auction.
Can a developer cancel my off-the-plan contract?
Not under a sunset clause on a residential off-the-plan contract without your written consent or a Supreme Court order.
Can a Sydney law firm act on a Victorian property?
Yes. NSW and Victoria are both part of the Legal Profession Uniform Law.
