Ballarat was built on gold, and the goldfields still shape its property. The city centre is full of heritage buildings, the ground underneath parts of it was mined, and its newest suburbs are growing fast on the western edge.
Optimum Lawyers is a Parramatta property law firm that acts on Victorian purchases, sales and transfers for clients who live in other states.

Send us the contract and Section 32 before you sign
We offer a free initial contract assessment. It is a brief first look at whether the contract appears ready for a full paid legal review. It is not the full review, and it is not free conveyancing.
Checks that are specific to Ballarat
- Heritage overlays. Much of central Ballarat and its older suburbs is covered by heritage overlays that control demolition and change.
- Old mine workings. The Victorian Government publishes historical mining data, including mine shafts. If you plan to build or extend, check the ground conditions.
- Growth area land. In the western growth area around Alfredton, Delacombe and Lucas, land is often sold before registration. Check the sunset date, what can change and the covenants.
- No growth area charge. The Growth Areas Infrastructure Contribution applies only in seven Melbourne councils, not in Ballarat.
Victorian contract basics
The Section 32 vendor statement is given to you before you sign, and if it is missing, incomplete or inaccurate the contract is not binding on the buyer. The cooling-off period is 3 clear business days from the day you sign, and you forfeit the greater of $100 or 0.2% of the price if you withdraw. There is none at auction. Since 1 October 2026 the agent must disclose the seller’s reserve price at least 7 days before an auction or fixed-date sale.
Selling a Ballarat property from interstate
The Section 32 must be complete and accurate. On a contract under the threshold the seller’s land tax cannot be passed on to the buyer. Every seller needs an ATO clearance certificate, or the buyer must withhold 15% of the price at settlement.
Transfers without a sale
We also act on transfers between partners, after a separation, from a deceased estate, and into or out of a trust or self-managed super fund. Victorian duty can apply even where no money changes hands, so get advice before anything is signed.
Lawyer or conveyancer?
A conveyancer can handle a simple purchase well. A property lawyer can also advise on what a heritage overlay or a developer’s land contract means for you, negotiate special conditions, and act for you if the sale is disputed.
