Newcastle was built over coal workings, and that still shapes property sales here. Large parts of Newcastle and Lake Macquarie are inside mine subsidence districts, and whether a house was built with the right approval matters when it is sold.
Optimum Lawyers is a Parramatta property law firm. We act for Newcastle and Hunter buyers and sellers by phone, email and video, and NSW property settles electronically.

Send us the contract before you exchange
We offer a free initial contract assessment. It is a brief first look at whether the contract appears ready for a full paid legal review. It is not the full review, and it is not free conveyancing.
Mine subsidence, and why it matters at sale
- Approvals. Structures in a mine subsidence district need approval that meets Subsidence Advisory NSW’s requirements. We check that the house and any later additions have it.
- The buyer’s exit. Under the Coal Mine Subsidence Compensation Act 2017, a buyer may be able to withdraw from a contract where a structure is not compliant.
- Claim history. There is no public register of subsidence claims, so the seller has to be asked. If a claim was paid and the damage was not repaired, the seller must disclose it and the buyer cannot claim again for that damage.
NSW contract basics
- The contract comes first. A NSW property cannot be offered for sale until the contract has been prepared, so it can be reviewed before you make an offer.
- Cooling-off. 5 business days on a private sale, ending at 5pm on the fifth business day. You forfeit 0.25% of the price if you withdraw. It is 10 business days for off-the-plan purchases.
- Auctions. No cooling-off period applies.
Other Newcastle checks
- Heritage conservation areas. Cooks Hill, The Hill and Hamilton South have controls on alterations and demolition.
- Flood. Low-lying suburbs near the harbour and Throsby Creek can be flood affected. The planning certificate attached to the contract says whether flood controls apply.
- Apartments. For the newer buildings around Honeysuckle, Wickham and Newcastle West, the strata records show levies, defects and disputes.
Hunter residents buying in another state
We also act on purchases and sales in Queensland, Victoria, Western Australia and the ACT for clients who live in NSW. The contract and cooling-off rules differ in each, so send us the contract before you sign it.
Beyond the Newcastle council area
Lake Macquarie, Maitland, Port Stephens and Cessnock are separate councils with their own planning controls. Central Maitland is known for flood risk from the Hunter River, and Lake Macquarie has its own mine subsidence district. The searches change with the council.
Transfers without a sale
We also act on transfers between partners, after a separation, from a deceased estate, and into or out of a trust or self-managed super fund. NSW duty can apply, and some transfers qualify for an exemption with conditions, so get advice first.
Lawyer or conveyancer?
A conveyancer can handle a simple purchase well. A property lawyer can also advise on what a missing subsidence approval or an old claim means for you, negotiate the contract around it, and act for you if the matter is disputed.
What clients say about our NSW work

Questions about conveyancing in Newcastle
How do I know if a property is in a mine subsidence district?
The planning certificate attached to the contract states it, and Subsidence Advisory NSW publishes maps of each district.
What if the house was built without subsidence approval?
It can affect compensation for future damage and may give a buyer the right to withdraw. Raise it before exchange, not after.
How long is the cooling-off period in NSW?
Five business days on a private sale. You forfeit 0.25% of the price if you withdraw.
Do you have a Newcastle office?
No. We are in Parramatta and act for Hunter clients remotely. Settlement in NSW is electronic.
