Toowoomba sits on the edge of the Great Dividing Range, two hours west of Brisbane, and its buyers range from families in the established suburbs to investors and acreage buyers around Highfields and the rural fringe.
Optimum Lawyers is a Parramatta property law firm that acts on Queensland purchases, sales and transfers for clients who live in other states.

Send us the contract before you sign it
We offer a free initial contract assessment. It is a brief first look at whether the contract appears ready for a full paid legal review. It is not the full review, and it is not free conveyancing.
Checks that are specific to Toowoomba
- Flood. Toowoomba is high on the range, but the January 2011 flash flood showed how fast its creeks can rise. Check the council flood mapping for the address.
- Acreage. Rural residential lots can rely on tank water, bores and on-site sewage, and may carry easements for access or services.
- Character homes. Older homes in the established suburbs can be subject to character or heritage controls that limit change.
- New estates. Around Highfields and Westbrook, check the sunset date and covenants on any land bought before registration.
Queensland contract basics
The selling agent usually prepares the contract. The cooling-off period is 5 business days from the day you receive it signed by both parties, and the seller can keep up to 0.25% of the price if you withdraw. There is none at auction. Since 1 August 2025 the seller must give you a seller disclosure statement (Form 2) and prescribed certificates before you sign. It does not cover flooding history, the structural soundness of the building, or past building approvals.
Selling a Toowoomba property from interstate
The seller disclosure statement and certificates must reach the buyer before they sign. A dwelling being sold needs interconnected photoelectric smoke alarms, and a pool needs a pool safety certificate.
Transfers without a sale
We also act on transfers between partners, after a separation, from a deceased estate, and into or out of a trust or self-managed super fund. Queensland transfer duty can apply even where no money changes hands, so get advice before anything is signed.
Lawyer or conveyancer?
A conveyancer can handle a simple purchase well. A property lawyer can also advise on acreage issues, easements and development controls, negotiate the contract, and act for you if the sale is disputed.
Questions about conveyancing in Toowoomba
What should I check when buying acreage near Toowoomba?
Water supply, on-site sewage approval, access and easements, and the zoning that applies to the land.

No. Flooding history is outside the Queensland seller disclosure scheme.
How long is the cooling-off period in Queensland?
Five business days from the day you receive the fully signed contract.
Can a NSW law firm act on a Toowoomba purchase?
