South Australia is conveyancer country. Most Adelaide sales are settled by licensed conveyancers, and they handle a routine purchase well. There are points in an SA sale, though, where the law specifically calls for a lawyer, and others where legal advice decides the outcome.
Optimum Lawyers is a property law firm led by principal solicitor Wisam Assi. We act on South Australian purchases, sales and transfers for clients in SA and in other states.

Send us the contract and Form 1 before you sign
We offer a free initial contract assessment. It is a brief first look at whether the contract appears ready for a full paid legal review. It is not the full review, and it is not free conveyancing.
When SA law calls for a lawyer
If you are asked to waive your cooling-off rights, for example to secure a property before auction, the waiver is only effective with a certificate from a lawyer confirming that you were given independent advice about it. A conveyancer cannot give that certificate.
Matters we handle in Adelaide
- The Form 1. The vendor's statement must be served on the buyer, and cooling-off runs from its service. If it was not served properly or is defective, the buyer may have rights to end the contract.
- Short cooling-off. It ends at the end of the second clear business day after the Form 1 is served. The seller can keep up to $100 of the deposit. That is very little time to get advice, so send the contract early.
- Trees and character areas. Regulated and significant trees, and character and heritage areas under the Planning and Design Code, can stop a knock-down or subdivision plan.
- Community and strata titles. The corporation's records, levies and by-laws.
When a sale does not go to plan
Late settlements, default notices, deposit disputes and problems discovered at the final inspection all turn on the contract and the notices served under it. We advise on where you stand and deal with the other side.
Selling in Adelaide
The Form 1 has to be prepared and served properly, because the buyer's cooling-off runs from its service and a defective statement can put the sale at risk. Every seller needs an ATO clearance certificate, or the buyer must withhold 15% of the price at settlement.
Transfers and ownership
We act on transfers between partners, after a separation, from a deceased estate, and into or out of a trust or self-managed super fund. South Australian stamp duty can apply even where no money changes hands.
Buying in Adelaide from another state
South Australia has drawn more interstate buyers than most states. See conveyancing in Adelaide for how an SA purchase runs step by step.
What clients say

Questions about property lawyers in Adelaide
Can I waive cooling-off in South Australia?
Yes, but only with a certificate from a lawyer confirming you received independent advice about the waiver. There is no cooling-off at auction.
How long is the cooling-off period in SA?
It ends at the end of the second clear business day after the Form 1 is served on you.
What is a Form 1?
The vendor’s statement a South Australian seller must serve on the buyer. It sets out the title, encumbrances, rates and other particulars of the property.
Can a NSW law firm act on an Adelaide purchase?
Yes. A solicitor holding a current Australian practising certificate can act on property in any state or territory.
