Stamp Duty in Queensland: What Buyers Need to Know
First home concessions, the home concession and duty for interstate buyers
Queensland transfer duty is administered by the Queensland Revenue Office and is paid by the buyer. Queensland made major changes for first home buyers from 1 May 2025, so advice that was right a year or two ago may now be wrong.
Optimum Lawyers is a property law firm in Parramatta Square, led by principal solicitor Wisam Assi. We act on purchases, sales, settlements and transfers in every Australian state and territory.

Send us the contract and we will check the duty
We offer a free initial contract assessment. It is a brief first look at whether the contract appears ready for a full paid legal review. It is not the full review, and it is not free conveyancing.
First home buyers
- New homes. For contracts signed from 1 May 2025, eligible first home buyers of a new home may pay no duty, whatever the value.
- Vacant land. Eligible first home buyers of vacant land to build their first home may also pay no duty, whatever the value.
- Established homes. No duty up to $700,000, and reduced duty for homes valued below $800,000.
Check the current conditions on the Queensland Government website. See also the First Home Owner Grant in Queensland.
The home concession
Buyers who are not first home buyers may still get the home concession if they will live in the property. You must move in within one year of settlement to keep it.
Foreign buyers
Foreign persons pay additional foreign acquirer duty of 8% on residential land in Queensland, on top of transfer duty.
Exemptions
Some transfers carry no duty, including transferring a share of your home to your spouse and changing how joint owners hold title, for example from joint tenants to tenants in common. See joint tenants vs tenants in common.
Buying in Queensland from interstate
Queensland duty applies to Queensland property wherever you live, and the first home concessions require you to live in the home. Read the seller disclosure statement before you sign, and see conveyancing Brisbane.
