Rockhampton sits on the Fitzroy River, one of the largest river systems on Australia's east coast, and its low-lying suburbs have flooded several times this century. Investors from the southern states buy here for the yields, often without seeing the property.

We offer a free initial contract assessment. It is a brief first look at whether the contract appears ready for a full paid legal review. It is not the full review, and it is not free conveyancing.
Checks that are specific to Rockhampton
- Fitzroy River flood. Check council flood mapping and get an insurance quote before the contract becomes unconditional. Flooding history is outside the seller disclosure scheme.
- Two councils. Yeppoon and the Capricorn Coast are in Livingstone Shire, a separate council from Rockhampton, with its own planning rules.
- Tenanted investments. The lease, rent, bond and end date, and how the contract deals with them.
- Older timber homes. Termites, tie-downs and enclosed lower levels built without approval.
Queensland contract basics
The selling agent usually prepares the contract. The cooling-off period is 5 business days from the day you receive it signed by both parties, and the seller can keep up to 0.25% of the price if you withdraw. There is none at auction. Since 1 August 2025 the seller must give you a seller disclosure statement (Form 2) and prescribed certificates before you sign. It does not cover flooding history, the structural soundness of the building, or past building approvals.
Selling in Rockhampton
The seller disclosure statement and certificates must reach the buyer before they sign. A dwelling needs interconnected photoelectric smoke alarms, and a pool needs a pool safety certificate. Every seller needs an ATO clearance certificate, or the buyer must withhold 15% of the price at settlement.
Transfers without a sale
We also act on transfers between partners, after a separation, from a deceased estate, and into or out of a trust or self-managed super fund. Queensland transfer duty can apply even where no money changes hands, so get advice before anything is signed.
Lawyer or conveyancer?
A conveyancer can handle a simple purchase well. A property lawyer can also advise on the contract before you sign, negotiate its terms, and act for you if the sale is disputed.

Should I get insurance quotes before buying?
Yes, before the contract becomes unconditional.
How long is the cooling-off period in Queensland?
Five business days from the day you receive the contract signed by both parties. There is none at auction.
Can a NSW law firm act on a Queensland property?
Yes. A solicitor holding a current Australian practising certificate can act on property in any state or territory.

I recently sold my investment property with Wisam of Optimum Lawyers as solicitor. I had used Wisam some 14 years earlier in the purchase of the property and subsequently with other property purchases. Much of the work involved with the sale of the property this year took place while I was away on my family's first and long-delayed overseas trip to see relatives. Wisam kept me well updated and informed throughout the process, especially as he dealt with a challenging purchaser solicitor who seemed frequently otherwise distracted and asking for multiple settlement delays. While we agreed to accommodate as much as was acceptable, Wisam strongly asserted my rights in having the sale proceed promptly as per the contract. I plan to ask Wisam to deal with future sales and purchases as and when they occur.
