Mackay is a sugar and mining city on the central Queensland coast, and much of its interstate demand comes from investors. The rental market moves with the mines, and the weather moves with the cyclone season. Both belong in the contract.
Optimum Lawyers is a Parramatta property law firm that acts on Queensland purchases, sales and transfers for clients who live in other states.

Send us the contract before you sign it
We offer a free initial contract assessment. It is a brief first look at whether the contract appears ready for a full paid legal review. It is not the full review, and it is not free conveyancing.
Checks that are specific to Mackay
- Insurance. Mackay is in cyclone country. Get a written quote for the address before the contract becomes unconditional.
- Flood. The Pioneer River and local creeks can flood low-lying suburbs, and the seller does not have to disclose flooding history.
- The tenancy. If you are buying with a tenant in place, read the lease: the rent, the end date and the bond. The rent is part of what you are paying for.
- Rural and cane land. Properties on the fringe can carry easements for cane railways, drainage or services.
Queensland contract basics
The selling agent usually prepares the contract. The cooling-off period is 5 business days from the day you receive it signed by both parties, and the seller can keep up to 0.25% of the price if you withdraw. There is none at auction. Since 1 August 2025 the seller must give you a seller disclosure statement (Form 2) and prescribed certificates before you sign. It does not cover flooding history, the structural soundness of the building, or past building approvals.
Selling a Mackay property from interstate
The seller disclosure statement and certificates must reach the buyer before they sign. A dwelling being sold needs interconnected photoelectric smoke alarms. If the property is tenanted, the lease and bond are dealt with in the contract.
Transfers without a sale
We also act on transfers between partners, after a separation, from a deceased estate, and into or out of a trust or self-managed super fund. Queensland transfer duty can apply even where no money changes hands, so get advice before anything is signed. See stamp duty in Queensland.
Lawyer or conveyancer?
A conveyancer can handle a simple purchase well. An investor buying sight unseen needs advice on the contract and lease before signing, conditions written for the risks of the address, and someone to act if the property is not as described.
