Buying Your First Home in NSW: A Property Lawyer's Guide
Stamp duty, grants, the 5% deposit scheme and the contract, in the order they matter
Most first home buyers in NSW can save tens of thousands of dollars through stamp duty relief, and some also qualify for a grant or a lower deposit. Each scheme has its own conditions, and some have to be dealt with before you exchange, so it pays to sort them out early.
Optimum Lawyers is a property law firm in Parramatta Square, led by principal solicitor Wisam Assi. We act on purchases, sales, settlements and transfers in every Australian state and territory.

Send us the contract before you exchange
We offer a free initial contract assessment. It is a brief first look at whether the contract appears ready for a full paid legal review. It is not the full review, and it is not free conveyancing.
Stamp duty relief
Under the First Home Buyers Assistance Scheme, eligible buyers pay no transfer duty on a home up to $800,000 and reduced duty below $1 million. For vacant land to build on, there is no duty up to $350,000 and reduced duty below $450,000. You must move in within 12 months of settlement and live there for at least 12 continuous months. See stamp duty in NSW or try the NSW stamp duty calculator.
The First Home Owner Grant
NSW pays a $10,000 First Home Owner Grant on eligible new homes, including homes you build, subject to value caps. It is not available for established homes. At least one buyer must be an Australian citizen or permanent resident and live in the home for 12 continuous months. Check the current caps with Revenue NSW before you sign. Buying in another state? See the first home owner grant in Queensland, Victoria and WA.
The 5% Deposit Scheme
Under the Australian Government 5% Deposit Scheme, eligible first home buyers can buy with a 5% deposit without paying lenders mortgage insurance. Since 1 October 2025 there are no income caps and no limit on places, but property price caps still apply. You apply through a participating lender. See our article on the 5% deposit scheme in NSW.
What to check in the contract
- Cooling-off. Private sales in NSW have a 5 business day cooling-off period, or 10 for off-the-plan. There is none at auction, so get the contract checked before auction day.
- Finance. NSW contracts are not usually subject to finance. Have formal approval, or a plan, before you exchange.
- Strata records. For a unit or townhouse, check levies, special levies and defects.
- Inclusions and repairs. Make sure what you expect to get is written into the contract.
Timing matters
Concessions and grants have forms to lodge, and the stamp duty exemption is claimed through your lawyer or conveyancer before settlement. Tell us at the start that you are a first home buyer so nothing is missed.
