Cairns property bought from interstate tends to be one of two things: a holiday or investment unit near the Esplanade, or a house in the suburbs that the buyer will rent out or move into later. Both sit in cyclone country, and Queensland’s seller disclosure leaves the weather out.
Optimum Lawyers is a Parramatta property law firm that acts on Queensland purchases, sales and transfers for clients who live in other states.

Send us the contract before you sign it
We offer a free initial contract assessment. It is a brief first look at whether the contract appears ready for a full paid legal review. It is not the full review, and it is not free conveyancing.
Checks that are specific to Cairns
- Insurance first. Cyclone and flood exposure drive premiums in Far North Queensland. Get a written quote for the address before your finance and inspection dates pass.
- Flood and storm tide. Low-lying parts of Cairns are exposed to flooding and storm tide. The seller does not have to disclose flooding history, so check the council mapping yourself.
- Holiday units. If the unit is in a letting pool, read the management rights and letting agreements, and check the by-laws and the building’s approved use before you count on holiday income.
- Older houses. Elevated timber homes need a careful building and pest inspection, with termites and tie-downs on the list.
Queensland contract basics
The selling agent usually prepares the contract. The cooling-off period is 5 business days from the day you receive it signed by both parties, and the seller can keep up to 0.25% of the price if you withdraw. There is none at auction. Since 1 August 2025 the seller must give you a seller disclosure statement (Form 2) and prescribed certificates before you sign. It does not cover flooding history, the structural soundness of the building, or past building approvals.
Selling a Cairns property from interstate
The seller disclosure statement and certificates must reach the buyer before they sign, or the buyer may be able to terminate up to settlement. A dwelling being sold needs interconnected photoelectric smoke alarms, and a pool needs a pool safety certificate.
Transfers without a sale
We also act on transfers between partners, after a separation, from a deceased estate, and into or out of a trust or self-managed super fund. Queensland transfer duty can apply even where no money changes hands, so get advice before anything is signed.
Lawyer or conveyancer?
A conveyancer can handle a simple purchase well. For a buyer who cannot inspect the property, a property lawyer adds advice on the contract and management agreements before signing, conditions written for the risks of the address, and representation if something goes wrong.
Questions about conveyancing in Cairns
Should I get an insurance quote before I buy in Cairns?
Yes, before the contract becomes unconditional at the latest. If the premium changes the numbers, you want to know while you can still withdraw.
Does the seller have to disclose flooding?
No. Flooding history is outside the Queensland seller disclosure scheme.
Can I holiday let a Cairns apartment?
It depends on the building’s approved use, its by-laws and any letting agreement in place. Check before you sign.
How long is the cooling-off period in Queensland?
Five business days from the day you receive the fully signed contract. There is none at auction.
