Darwin draws buyers from every other state: investors after yields, and people moving north for defence, government and resources work. The Northern Territory contract is simpler than most, but the risks of a tropical city are not, and both need checking before you sign.
Optimum Lawyers is a Parramatta property law firm that acts on Northern Territory purchases, sales and transfers for clients who live in other states.

Send us the contract before you sign it
We offer a free initial contract assessment. It is a brief first look at whether the contract appears ready for a full paid legal review. It is not the full review, and it is not free conveyancing.
How a Darwin purchase runs
- The approved form. NT contracts must use the approved form and name the buyer’s and seller’s conveyancers or solicitors.
- Cooling-off is 4 business days. It starts on the day the contract is last signed and exchanged. You can cancel without penalty or explanation, and the period can be waived, shortened or extended by agreement.
- No cooling-off at auction.
- Not binding until exchange. The contract is not binding until both copies are exchanged.
Checks that are specific to Darwin
- Storm surge. The NT Government publishes storm surge mapping for the Darwin region. Low-lying coastal suburbs can be affected, which matters for insurance and for what you can build.
- Cyclone construction. Building rules changed after Cyclone Tracy in 1974. Ask the building inspector how the house is tied down, and check approvals for any later additions.
- Insurance. Cyclone exposure drives premiums in the Top End. The federal cyclone reinsurance pool covers home, landlord and residential strata policies, but get a quote for the actual address before you are committed.
- Termites. A building and pest inspection is part of any sensible Darwin purchase.
- Defence leases. Some investment properties are leased to Defence Housing Australia. The lease stays with the property when it sells, so read its terms before you price the purchase.
Units in Darwin
Many Darwin investment purchases are units. Read the body corporate records for levies, insurance and planned works before the cooling-off period ends.
Selling a Darwin property from interstate
Every seller needs an ATO clearance certificate, or the buyer must withhold 15% of the price at settlement. If the property is tenanted, the lease and bond are dealt with in the contract. You sign from home.
Transfers without a sale
We also act on transfers between partners, after a separation, from a deceased estate, and into or out of a trust or self-managed super fund. Territory duty can apply even where no money changes hands, so get advice before anything is signed.
Lawyer or conveyancer?
A conveyancer can handle a simple Darwin purchase well. A property lawyer can also advise on the contract and any existing lease before you sign, negotiate special conditions, and act for you if the sale is disputed.
