Gawler is one of South Australia's oldest country towns, now on the northern edge of Adelaide's growth. Heritage streets in the town centre sit beside new estates in Gawler East and Evanston, and the Gawler River runs through it all.

Checks that are specific to Gawler
- Gawler River flood. Low-lying land near the North and South Para and the Gawler River can be flood affected. Check the planning information for the address.
- Heritage. The town centre and older streets include heritage places and character areas that control change.
- New estates. Covenants, design guidelines, and whether the title has issued on new lots.
- Two councils. The Barossa and Light Regional councils surround the Town of Gawler, with their own rules.
How an SA purchase runs
- Form 1 comes first. The seller must serve a vendor's statement, known as the Form 1, on the buyer. It sets out the title, encumbrances, rates and other particulars of the property.
- Cooling-off is short. It ends at the end of the second clear business day after the Form 1 is served on you. You cancel by written notice, and the seller can keep up to $100 of the deposit.
- No cooling-off at auction. To waive cooling-off on a private sale you need a certificate from a lawyer confirming you were advised first.
Selling in Gawler
The Form 1 has to be prepared and served properly, because the buyer's cooling-off runs from its service. Every seller needs an ATO clearance certificate, or the buyer must withhold 15% of the price at settlement.
Transfers without a sale
We also act on transfers between partners, after a separation, from a deceased estate, and into or out of a trust or self-managed super fund. South Australian stamp duty can apply even where no money changes hands, so get advice before anything is signed.
Lawyer or conveyancer?
South Australia has a strong conveyancer tradition, and a good conveyancer handles a straightforward purchase well. A property lawyer can also advise on the contract and Form 1 before you sign, give the certificate needed to waive cooling-off, and act for you if the sale is disputed.

Questions about conveyancing in Gawler
Is the Form 1 a building report?
No. It sets out the title, encumbrances, rates and other particulars. A building and pest inspection is separate.
Can I waive cooling-off in SA?
Yes, but only with a certificate from a lawyer confirming you were advised about it.
How long is the cooling-off period in SA?
It ends at the end of the second clear business day after the Form 1 is served on you. The seller can keep up to $100 of the deposit if you cancel.
Can a NSW law firm act on a South Australian property?
Yes. A solicitor holding a current Australian practising certificate can act on property in any state or territory.

Back in 2023, I urgently needed someone to review contract documents within a few hours or I was going to lose the opportunity. As a young investor, I wasn’t fully familiar with the process and definitely wasn’t prepared. I recently sold my investment property with Wisam of Optimum Lawyers as solicitor. I had used Wisam some 14 years earlier in the purchase of the property and subsequently with other property purchases. Much of the work involved with the sale of the property this year took place while I was away on my family's first and long-delayed overseas trip to see relatives. Wisam kept me well updated and informed throughout the process, especially as he dealt with a challenging purchaser solicitor who seemed frequently otherwise distracted and asking for multiple settlement delays. While we agreed to accommodate as much as was acceptable, Wisam strongly asserted my rights in having the sale proceed promptly as per the contract. I plan to ask Wisam to deal with future sales and purchases as and when they occur.
