Victor Harbor is South Australia's favourite place to retire, and a popular spot for holiday houses. Buyers often come from Adelaide and interstate, and many buy into retirement villages or over-55 communities where the documents are very different from a house contract.
Optimum Lawyers is a property law firm led by principal solicitor Wisam Assi. We act on South Australian purchases, sales and transfers for clients in SA and in other states.

Send us the contract before you sign it
We offer a free initial contract assessment. It is a brief first look at whether the contract appears ready for a full paid legal review. It is not the full review, and it is not free conveyancing.
Checks that are specific to Victor Harbor
- Retirement villages. A retirement village home is usually held under a lease or licence with ongoing fees and an exit fee. Read the contract and disclosure documents before you commit.
- Coastal land. Beachfront and low-lying land around Encounter Bay can be affected by coastal hazard controls.
- Holiday houses. A second home is not your principal place of residence, so SA land tax can apply. Work out the holding costs first.
- Neighbouring council. Goolwa and Port Elliot are in Alexandrina Council, not the City of Victor Harbor.
How an SA purchase runs
- Form 1 comes first. The seller must serve a vendor's statement, known as the Form 1, on the buyer. It sets out the title, encumbrances, rates and other particulars of the property.
- Cooling-off is short. It ends at the end of the second clear business day after the Form 1 is served on you. You cancel by written notice, and the seller can keep up to $100 of the deposit.
- No cooling-off at auction. To waive cooling-off on a private sale you need a certificate from a lawyer confirming you were advised first.
Selling in Victor Harbor
The Form 1 has to be prepared and served properly, because the buyer's cooling-off runs from its service. Every seller needs an ATO clearance certificate, or the buyer must withhold 15% of the price at settlement.
Transfers without a sale
We also act on transfers between partners, after a separation, from a deceased estate, and into or out of a trust or self-managed super fund. South Australian stamp duty can apply even where no money changes hands, so get advice before anything is signed.
Lawyer or conveyancer?
South Australia has a strong conveyancer tradition, and a good conveyancer handles a straightforward purchase well. A property lawyer can also advise on the contract and Form 1 before you sign, give the certificate needed to waive cooling-off, and act for you if the sale is disputed.
What clients say
“Wisam has been my solicitor for both purchasing and selling my property.”

Questions about conveyancing in Victor Harbor
Is buying into a retirement village the same as buying a house?
Usually not. Most retirement village homes are held under a lease or licence with ongoing fees and an exit fee.
Is Port Elliot in the City of Victor Harbor?
No. Port Elliot and Goolwa are in Alexandrina Council.
How long is the cooling-off period in SA?
It ends at the end of the second clear business day after the Form 1 is served on you. The seller can keep up to $100 of the deposit if you cancel.
Can a NSW law firm act on a South Australian property?
Yes. A solicitor holding a current Australian practising certificate can act on property in any state or territory.
