Holiday apartments, river frontage and letting rules in Noosa Shire
Noosa is a favourite for interstate buyers wanting a holiday home or a future retirement base. Many plan to let the property when they are away, and Noosa Shire regulates short-term accommodation, so that needs checking along with the body corporate records.

Checks that are specific to Noosa
- Short-term accommodation. Noosa Shire regulates short-term accommodation. Check with the council that the property can be let the way you intend before you sign
- Body corporate. Holiday apartments often have a management rights arrangement. Check the levies, sinking fund and the caretaking and letting agreement
- River and canal frontage. Check flood mapping and any approvals for jetties, pontoons and revetment walls
- Seller disclosure. Queensland sellers must give a disclosure statement before you sign
Queensland contract basics
The selling agent usually prepares the contract. The cooling-off period is 5 business days from the day you receive it signed by both parties, and the seller can keep up to 0.25% of the price if you withdraw. There is none at auction. Since 1 August 2025 the seller must give you a seller disclosure statement (Form 2) and prescribed certificates before you sign. It does not cover flooding history, the structural soundness of the building, or past building approvals.
Selling in Noosa
The seller disclosure statement and certificates must reach the buyer before they sign. A dwelling needs interconnected photoelectric smoke alarms, and a pool needs a pool safety certificate. Every seller needs an ATO clearance certificate, or the buyer must withhold 15% of the price at settlement.
Transfers without a sale
We also act on transfers between partners, after a separation, from a deceased estate, and into or out of a trust or self-managed super fund. Queensland transfer duty can apply even where no money changes hands, so get advice before anything is signed. See stamp duty in Queensland.
Lawyer or conveyancer?
A conveyancer can handle a simple purchase well. A property lawyer can also advise on the contract before you sign, negotiate its terms, and act for you if the sale is disputed.

Questions about conveyancing in Noosa
Can I holiday let my Noosa property?
It depends on the council rules for that property. Check with Noosa Shire Council before you buy.
What is a management rights arrangement?
An arrangement where a caretaker manages the complex and runs the letting pool. It affects how your apartment can be let.
How long is the cooling-off period in Queensland?
Five business days from the day you receive the contract signed by both parties. There is none at auction.
Can a NSW law firm act on a Queensland property?
Yes. A solicitor holding a current Australian practising certificate can act on property in any state or territory.

I recently sold my investment property with Wisam of Optimum Lawyers as solicitor. I had used Wisam some 14 years earlier in the purchase of the property and subsequently with other property purchases. Much of the work involved with the sale of the property this year took place while I was away on my family's first and long-delayed overseas trip to see relatives. Wisam kept me well updated and informed throughout the process, especially as he dealt with a challenging purchaser solicitor who seemed frequently otherwise distracted and asking for multiple settlement delays. While we agreed to accommodate as much as was acceptable, Wisam strongly asserted my rights in having the sale proceed promptly as per the contract. I plan to ask Wisam to deal with future sales and purchases as and when they occur.
