A Gold Coast apartment is never just an apartment. It comes with a body corporate, a set of by-laws, a sinking fund, and often a resident manager or a letting pool. A waterfront house comes with its own questions about the land and the water. Those documents decide what you are really buying.
Optimum Lawyers is a property law firm led by principal solicitor Wisam Assi. We act on Gold Coast purchases, sales and transfers for clients in Queensland and interstate.

Send us the contract before you sign it
We offer a free initial contract assessment. It is a brief first look at whether the contract appears ready for a full paid legal review. It is not the full review, and it is not free conveyancing.
What a property lawyer adds
A conveyancer can process a simple purchase well. Where a lawyer earns the fee is in reading the body corporate records, management agreements and disclosure documents, advising what they mean for you, negotiating the contract, and acting for you if there is a dispute with the seller or the body corporate.
Matters we handle on the Gold Coast
- Body corporate records. Levies, the sinking fund forecast, special levies, defect reports, by-law contraventions and disputes in the minutes.
- Letting pools and management rights. Whether a unit is in a letting pool, what the letting appointment says, and whether the building's approved use allows short-term letting.
- Off-the-plan towers. The disclosure statement, how much the developer can change the lot, the sunset date and how the deposit is held.
- Canal and waterfront homes. Revetment walls, pontoons and jetties, easements, and the flood and storm tide information the seller does not have to disclose.
- Seller disclosure. Since 1 August 2025 the seller must give a disclosure statement and certificates before you sign. If they were not given or are materially wrong, a buyer may be able to terminate before settlement.
Body corporate disputes
Disputes with a body corporate or another owner, about by-laws, levies, repairs or use of common property, go first to the Commissioner for Body Corporate and Community Management. We advise on where you stand before it gets that far.
Selling on the Gold Coast
The seller disclosure statement and certificates must reach the buyer before they sign. A dwelling needs interconnected photoelectric smoke alarms, and a pool needs a pool safety certificate. Every seller needs an ATO clearance certificate, or the buyer must withhold 15% of the price at settlement.
Transfers and ownership
We act on transfers between partners, after a separation, from a deceased estate, and into or out of a trust or self-managed super fund. Queensland transfer duty can apply even where no money changes hands. Foreign buyers pay additional foreign acquirer duty of 8% on residential land.
Buying from another state
Many Gold Coast buyers live in Sydney or Melbourne. Documents are signed where you live and settlement is electronic. See conveyancing on the Gold Coast for the step-by-step process.

Questions about property lawyers on the Gold Coast
Can I holiday let my Gold Coast apartment?
It depends on the building’s approved use, the by-laws and any letting arrangements already in place. Check before you sign.
Who resolves disputes with a body corporate in Queensland?
The Commissioner for Body Corporate and Community Management deals with most body corporate disputes in the first instance.
Does the seller have to disclose flooding?
No. Flooding history is outside the Queensland seller disclosure scheme.
Can a NSW law firm act on a Gold Coast purchase?
Yes. A solicitor holding a current Australian practising certificate can act on property in any state or territory.
