In January 2013 the Burnett River reached a record flood at Bundaberg, and North Bundaberg was among the worst hit areas. More than a decade later, flood is still the first question on many Bundaberg purchases, alongside coastal living at Bargara and rural land in cane country.
Optimum Lawyers is a property law firm led by principal solicitor Wisam Assi. We act on Queensland purchases, sales and transfers for clients in Queensland and in other states.

Send us the contract before you sign it
We offer a free initial contract assessment. It is a brief first look at whether the contract appears ready for a full paid legal review. It is not the full review, and it is not free conveyancing.
Checks that are specific to Bundaberg
- Flood. Check the council flood mapping for the address and get an insurance quote. Flooding history is outside the seller disclosure scheme.
- Coastal property. Bargara and the coastal towns have storm tide and erosion controls on some beachfront land.
- Cane and rural land. Easements for cane tramways, drainage and power, water allocations and what the rural zone allows.
- Units. Body corporate levies, by-laws and any disputes.
Queensland contract basics
The selling agent usually prepares the contract. The cooling-off period is 5 business days from the day you receive it signed by both parties, and the seller can keep up to 0.25% of the price if you withdraw. There is none at auction. Since 1 August 2025 the seller must give you a seller disclosure statement (Form 2) and prescribed certificates before you sign. It does not cover flooding history, the structural soundness of the building, or past building approvals.
Selling in Bundaberg
The seller disclosure statement and certificates must reach the buyer before they sign. A dwelling needs interconnected photoelectric smoke alarms, and a pool needs a pool safety certificate. Every seller needs an ATO clearance certificate, or the buyer must withhold 15% of the price at settlement.
Transfers without a sale
We also act on transfers between partners, after a separation, from a deceased estate, and into or out of a trust or self-managed super fund. Queensland transfer duty can apply even where no money changes hands, so get advice before anything is signed.
Lawyer or conveyancer?
A conveyancer can handle a simple purchase well. A property lawyer can also advise on the contract before you sign, negotiate its terms, and act for you if the sale is disputed.
What clients say

Questions about conveyancing in Bundaberg
Did the 2013 flood affect the property I am buying?
Ask the seller and agent, check council flood mapping, and get a building inspection. The seller does not have to disclose flooding history.
What easements are common on Bundaberg rural land?
Cane tramway, drainage, power and access easements. The title search shows them.
How long is the cooling-off period in Queensland?
Five business days from the day you receive the contract signed by both parties. There is none at auction.
Can a NSW law firm act on a Queensland property?
Yes. A solicitor holding a current Australian practising certificate can act on property in any state or territory.
