Hervey Bay is one of the most popular retirement destinations on the Queensland coast, and many buyers come from interstate. A good number buy into over-50s communities where you own the home but lease the land, which works very differently from buying a house.
Optimum Lawyers is a property law firm led by principal solicitor Wisam Assi. We act on Queensland purchases, sales and transfers for clients in Queensland and in other states.

Send us the contract before you sign it
We offer a free initial contract assessment. It is a brief first look at whether the contract appears ready for a full paid legal review. It is not the full review, and it is not free conveyancing.
Checks that are specific to Hervey Bay
- Land lease communities. In many over-50s communities you buy the home and pay site fees for the land. These are governed by Queensland's residential parks law, and the site agreement, fee increases and exit terms need reading before you commit.
- Storm tide and flood. Low-lying land along the Esplanade and the creeks can be affected by storm tide and flooding, which the seller does not have to disclose.
- One council, two cities. Hervey Bay and Maryborough are both in the Fraser Coast Regional Council area.
- Units. Body corporate levies, sinking fund, by-laws and any disputes.
Queensland contract basics
The selling agent usually prepares the contract. The cooling-off period is 5 business days from the day you receive it signed by both parties, and the seller can keep up to 0.25% of the price if you withdraw. There is none at auction. Since 1 August 2025 the seller must give you a seller disclosure statement (Form 2) and prescribed certificates before you sign. It does not cover flooding history, the structural soundness of the building, or past building approvals.
Selling in Hervey Bay
The seller disclosure statement and certificates must reach the buyer before they sign. A dwelling needs interconnected photoelectric smoke alarms, and a pool needs a pool safety certificate. Every seller needs an ATO clearance certificate, or the buyer must withhold 15% of the price at settlement.
Transfers without a sale
We also act on transfers between partners, after a separation, from a deceased estate, and into or out of a trust or self-managed super fund. Queensland transfer duty can apply even where no money changes hands, so get advice before anything is signed.
Lawyer or conveyancer?
A conveyancer can handle a simple house purchase well. A land lease site agreement or a retirement village contract is where a lawyer's advice on what you are signing earns its fee.
What clients say
