Essendon, Moonee Ponds and Ascot Vale are auction country. Period homes in heritage streets sell on Saturday with no cooling-off, and newer apartments around Moonee Ponds Junction come with owners corporations and their own records to read.
Optimum Lawyers is a property law firm led by principal solicitor Wisam Assi. We act on Victorian purchases, sales and transfers for clients in Victoria and interstate.

Send us the contract and Section 32 before you sign
We offer a free initial contract assessment. It is a brief first look at whether the contract appears ready for a full paid legal review. It is not the full review, and it is not free conveyancing.
Checks that are specific to Essendon
- Auctions. No cooling-off once the hammer falls. Since 1 October 2026 the reserve must be disclosed at least 7 days before, which is the window to have the contract read.
- Heritage overlays. Much of Essendon and Moonee Ponds is covered by heritage overlays that control demolition, extensions and front fences.
- Apartments. Owners corporation fees, special levies, defects and any proceedings on the owners corporation certificate.
- Flood. Low-lying streets near the Maribyrnong River and Moonee Ponds Creek can carry flood overlays. The October 2022 flood reached parts of the river flats.
- Aircraft noise. Some streets are affected by flight paths for Essendon Fields and Melbourne Airport. Check the planning controls for the address.
Victorian contract basics
The Section 32 vendor statement is given to you before you sign, and if it is missing, incomplete or inaccurate the contract may not be binding on the buyer. The cooling-off period is 3 clear business days from the day you sign, and you forfeit the greater of $100 or 0.2% of the price if you withdraw. There is none at auction. Since 1 October 2026 the agent must disclose the seller's reserve price at least 7 days before an auction or fixed-date sale.
Selling in Essendon
The Section 32 must be complete and accurate. In most residential sales the seller's land tax can no longer be passed on to the buyer. Every seller needs an ATO clearance certificate, or the buyer must withhold 15% of the price at settlement.
Transfers without a sale
We also act on transfers between partners, after a separation, from a deceased estate, and into or out of a trust or self-managed super fund. Victorian duty can apply even where no money changes hands, so get advice before anything is signed.
Lawyer or conveyancer?
A conveyancer can handle a simple purchase well. A property lawyer can also advise on the contract before you sign, negotiate its terms, and act for you if the sale is disputed.
