Sunbury Conveyancing and Property Lawyers

Sunbury is an old country town now inside Melbourne's growth boundary. Established homes and heritage streets in the town sit beside new estates growing to the south and north, so a Sunbury buyer might be reading a 19th century title or a brand new developer contract.

We offer a free initial contract assessment. It is a brief first look at whether the contract appears ready for a full paid legal review. It is not the full review, and it is not free conveyancing.
Checks that are specific to Sunbury
- Growth Areas Infrastructure Contribution. Sunbury is in Hume, one of the seven councils where GAIC can apply to growth area land. The Section 32 should say whether it affects the lot.
- New estates. The sunset date, deposit terms, what the developer can change and the estate covenants.
- House and land packages. Two contracts, one for the land and one for the build, with separate risks and deadlines.
- Heritage. Older parts of the town carry heritage overlays that control demolition and change.
- Creek and grassland land. Land near Jacksons Creek and the surrounding grassland can carry flood, bushfire or landscape controls.
Victorian contract basics
The Section 32 vendor statement is given to you before you sign, and if it is missing, incomplete or inaccurate the contract may not be binding on the buyer. The cooling-off period is 3 clear business days from the day you sign, and you forfeit the greater of $100 or 0.2% of the price if you withdraw. There is none at auction. Since 1 October 2026 the agent must disclose the seller's reserve price at least 7 days before an auction or fixed-date sale.
Selling in Sunbury
The Section 32 must be complete and accurate. In most residential sales the seller's land tax can no longer be passed on to the buyer. Every seller needs an ATO clearance certificate, or the buyer must withhold 15% of the price at settlement.
Transfers without a sale
We also act on transfers between partners, after a separation, from a deceased estate, and into or out of a trust or self-managed super fund. Victorian duty can apply even where no money changes hands, so get advice before anything is signed.
Lawyer or conveyancer?
A conveyancer can handle a simple purchase well. A property lawyer can also advise on the contract before you sign, negotiate its terms, and act for you if the sale is disputed.

Does GAIC apply in Sunbury?
It can apply to land in the Sunbury growth areas. The Section 32 should state whether it affects the lot.
How do I know if a Sunbury house has a heritage overlay?
The planning certificate in the Section 32 lists the overlays that apply.
How long is the cooling-off period in Victoria?
Three clear business days from the day you sign. You forfeit the greater of $100 or 0.2% of the price if you withdraw, and there is none at auction.
Can a NSW law firm act on a Victorian property?
Yes. NSW and Victoria are both part of the Legal Profession Uniform Law.

I recently sold my investment property with Wisam of Optimum Lawyers as solicitor. I had used Wisam some 14 years earlier in the purchase of the property and subsequently with other property purchases. Much of the work involved with the sale of the property this year took place while I was away on my family's first and long-delayed overseas trip to see relatives. Wisam kept me well updated and informed throughout the process, especially as he dealt with a challenging purchaser solicitor who seemed frequently otherwise distracted and asking for multiple settlement delays. While we agreed to accommodate as much as was acceptable, Wisam strongly asserted my rights in having the sale proceed promptly as per the contract. I plan to ask Wisam to deal with future sales and purchases as and when they occur.
